Crime comes in many different shapes and sizes, and can be defined in countless ways. In the past decade, new laws have come about legislating the societal issue of bullying. In response to recent spikes in suicide, especially in youth culture, the same laws that have always existed are becoming even more prevalent, sometimes altering their identity altogether. As to be expected, there have been specific cases that are disagreed upon by experts in the field. One of these was In Re D.S., in which the Iowa Supreme Court reversed a ruling involving a 15-year-old and her accused harassment of her peer.
These types of crimes have always hit hard for me, personally. Much of the criminal justice system is going to appear differently through every individual’s unique perspective of it. Throughout my life, I’ve always remembered a piece of common knowledge, “Just because laws exist doesn’t mean that they are right.” I felt even more compelled to research this concept of bullying, as it applies to my generation.
One of the major things touched on involving the specific case with the Iowa Supreme Court was whether or not there was enough evidence that the girl actually committed a crime. Many of the times, the United States of America government has been attempting to legislate these, and other similar moral behaviors. How I view it, this is basically someone’s right to be mean or be nice to someone else. This article was very interesting to me because it demonstrated on and briefly discussed if these types of laws are possibly restrictions on the First Amendment, freedom of speech, and several other rights we all have as American citizens. I thought this was compelling, in the context of research of the field of criminal law, as it introduced a new type of crime, one that might even be more common and plausible in my everyday life.
